Subdivision Variance

What is a Subdivision Variance?

Section 70-86 of the Subdivision Ordinance states that in cases where the subdivider can show that strict adherence to the public improvement requirements in articles III and IV of the Subdivision Ordinance would cause an unnecessary hardship, the Planning Commission may grant a variance to such requirements. When considering a variance, the Planning Commission must determine that because of topography or other conditions peculiar to the site, a departure from the requirements can be made without destroying the intent of the Subdivision Ordinance standards and provisions.

Application Deadline

Monday prior to the 2nd Wednesday of the month by 5 p.m.

Planning Commission Public Hearings are held on the 2nd Wednesday of the month.

Applicant Responsibilities

  1. Complete Subdivision Variance application form.
    The original and three (3) copies of the complete Subdivision Variance application, with original signatures on one copy, including all required development information
  2. Legal Description and common street address of the property (pg 3)
  3. Payment of Filing Fee
  4. Post a sign (supplied by the Planning Department) two Wednesdays prior to the Planning Commission Public Hearing),
      Sign fee is $25 for first sign and $20 for each additional sign.
  5. Advertising Fees will be billed separately
    (average cost is $100 per advertisement, with a minimum of two (2) advertisements required)
  6. Subdivision Plan of the proposed development, drawn to scale
    Submit 30 copies, plus 2 copies reduced to 11” by 17” paper, plus 2 copies reduced to 8 ½” by 11” paper
